- Who can the settlor be?
The settlor is usually an accountant, lawyer or other advisor. The settlor cannot be anyone who will benefit from the Trust. The settlor is simply the person who establishes the trust by paying the trustee the 'settlement sum' (in the case of our deed this is $10).
- What is the role of the appointor?
The appointor is the most powerful position in a Discretionary Trust as they can appoint or remove trustees. The appointor and the trustees can be the same people.
- What is the role of the trustees?
The trustees are the people who make all the decisions about the trust such as to whom, in what amounts and when the income or assets in the trust should be distributed, how to invest the trust assets, etc.
- How are the beneficiaries defined?
You nominate who the principal beneficiaries are to be (usually husband and wife, spouse etc) and then our deed will define a beneficiary group around those people (including family members and related companies). You can choose whether you wish to include step-children and step-grandchildren in the definition.
- Who drafted the Compleo Discretionary Trust deed?
The Compleo Discretionary Trust package has been written by Norman Waterhouse Lawyers, a leading law firm. The fund deed is written in plain English, is current with today's legislation and is periodically reviewed to keep up to date with changes in the law.
- Can I make changes if I have made a mistake?
Yes, but only up until the deed is signed and executed. After this we can't allow any further edits to your document.
- What format are the documents?
All the documents are in PDF format.
- Do you have a sample of the Trust deed I can view?
Yes but you'll need to sign up (it's free) first. Once signed in, you'll be able to see the sample Trst deed from our main Discretionary Trusts page.
- What payment methods do you accept?
At present only Visa or Mastercard. Shortly you can apply for an account and pay by monthly invoice.
- Do you provide ongoing management services for the Trust?
No we do not. You will need to seek the services of a suitably qualified professional to assist you with this.
